Terms of Use — AuditFlash.ai
1. Purpose and Acceptance
These Terms of Use ("ToU") govern access to and use of the AuditFlash.ai platform, accessible at aiflashaudit.com ("the Platform"), operated by Taher Mestiri, sole trader (auto-entrepreneur), SIRET 914 979 125 00012, 14, rue du Clos de la Herse, 45800 Saint-Jean-de-Braye, France.
Use of the Platform, including the free tier, constitutes unconditional acceptance of these ToU. If you do not accept these terms, you must refrain from using the Platform.
2. Service Description
AuditFlash.ai is an AI maturity audit SaaS platform aimed at executives and managers of French SMEs and mid-market companies. It enables users to:
- Complete a behavioural AI maturity diagnostic (no abstract self-assessment)
- Obtain a personalised report including a score, improvement areas, and sector-specific recommendations
- Compare their maturity level against anonymised sector benchmarks
Available tiers:
- Flash (149€ excl. VAT): short questionnaire (~10 questions), summary report
- Expert (699€ excl. VAT): in-depth questionnaire (18–20 sector-specific questions), detailed report
- Free diagnostic: 6 proxy questions, shareable LinkedIn score card, no account required
Prices are quoted excluding VAT. Applicable VAT is that in force on the date of order.
3. Account Creation and Access
Access to paid tiers requires creating a user account with a valid professional email address. Users agree to provide accurate information and keep it up to date.
Each account is strictly personal and may not be shared. Users are responsible for the confidentiality of their login credentials and all activity carried out from their account.
AuditFlash.ai reserves the right to suspend or delete any account whose information proves inaccurate or whose use is contrary to these ToU.
4. Financial Terms and Billing
4.1 Payment
Paid tiers are payable online by credit card via Stripe. Payments are processed at the time of order for Flash and Expert tiers.
4.2 Right of withdrawal
Pursuant to Art. L.221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to digital content provided immediately after the order, provided you have expressly waived your right of withdrawal by ticking the checkbox provided for this purpose at checkout.
4.3 Refunds
No refunds are granted for Flash and Expert tiers once the report has been generated and downloaded.
5. Intellectual Property
5.1 AuditFlash.ai's rights
The Platform, its source code, scoring algorithms, questionnaire models, designs, and all editorial content are the exclusive property of AuditFlash.ai or its licensors. Any reproduction, modification, distribution, or exploitation without prior written authorisation is prohibited.
5.2 User's rights over their data and reports
Audit reports generated from your answers belong to you. You are granted a personal, non-exclusive, non-transferable licence to use these reports for internal company purposes.
5.3 Aggregated data
AuditFlash.ai reserves the right to use aggregated and anonymised response data for research, service improvement, and sector benchmark production. These uses cannot in any way identify a specific user or company.
6. Use of Artificial Intelligence
Report generation relies on large language models (LLMs) provided by third parties (notably Anthropic). Reports produced are indicative only and constitute decision-support tools, not certified professional advice.
AuditFlash.ai does not guarantee the completeness, accuracy, or suitability of generated recommendations to any specific company's situation. Users are solely responsible for decisions taken on the basis of the reports provided.
Results may vary depending on the answers provided, the evolution of AI models, and the sector considered.
7. User Obligations
Users agree to:
- Provide sincere answers representative of their company's actual situation
- Not attempt to manipulate results by providing deliberately inaccurate answers
- Not use the Platform for unlawful, fraudulent purposes or in violation of these ToU
- Not attempt to access other users' data or circumvent security mechanisms
- Not use robots, scripts, or any automated means to access the Platform
8. Limitation of Liability
The Platform is provided "as is." AuditFlash.ai shall not be liable for:
- Service interruptions due to maintenance, technical incidents, or external causes (force majeure, infrastructure provider failures, etc.)
- Decisions taken by users on the basis of generated reports
- Inaccuracy of sector benchmarks in sectors where the dataset is insufficiently representative
- Any data loss resulting from user behaviour or an unauthorised third party
In any event, AuditFlash.ai's liability shall not exceed the amount actually paid by the user for the relevant service over the past 12 months.
9. Availability and Maintenance
AuditFlash.ai endeavours to ensure 99% platform availability per calendar month, excluding planned maintenance. Maintenance operations are notified by email 48 hours in advance where possible. No availability guarantee applies to the free tier.
10. Termination
10.1 By the user
Users may close their account at any time from their personal dashboard. Termination takes effect immediately for paid-per-report tiers.
10.2 By AuditFlash.ai
AuditFlash.ai may suspend or terminate a user's access in the event of a ToU violation, after formal notice remaining without effect for 48 hours, except in cases of urgency or serious breach.
11. ToU Updates
AuditFlash.ai may update these ToU at any time. In the event of a material change, users will be notified by email at least 15 days before the new version takes effect. Continued use of the Platform after this period constitutes acceptance of the updated ToU.
12. Governing Law and Jurisdiction
These ToU are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution within 30 days of notification.
Failing amicable resolution, the courts of Orléans (France) shall have exclusive jurisdiction, subject to mandatory consumer protection provisions.
Pursuant to Arts. L.612-1 et seq. of the French Consumer Code, individual users may refer disputes free of charge to the Médiateur du Commerce Électronique.
